Please read these Terms & Conditions carefully before using the Cully Express platform. These Terms govern your access to and use of our services. By using Cully Express, you confirm that you accept these Terms and agree to be bound by them.
1. Acceptance of Terms
By downloading, accessing, or using the Cully Express application or website, you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, you must not use our services.
These Terms constitute a legal agreement between you and A&S Signatures Ltd, a company registered in England and Wales with company number 15693230. Cully Express is a trading name of A&S Signatures Ltd.

2. Our Services
Cully Express operates a technology platform that connects customers with local restaurants and independent delivery drivers. We provide:
• A mobile application and website for customers to browse restaurants and place orders
• A partner platform for restaurants to list their menus and receive orders
• A driver application for independent couriers to accept and complete deliveries
Cully Express acts as an intermediary. The contract for food purchase is between you (the customer) and the restaurant. Delivery is carried out by independent self-employed drivers.
3. Account Registration
To use our services, you must create an account. You agree to:
• Provide accurate, complete, and up-to-date information
• Maintain the security of your password and account credentials
• Notify us immediately of any unauthorised use of your account
• Be responsible for all activity that occurs under your account
You must be 18 years of age or older to create an account. By creating an account, you confirm that you meet this requirement.
4. Ordering & Contracts
When you place an order through Cully Express:
• You are making an offer to purchase food from the selected restaurant
• The contract is formed when the restaurant confirms your order
• Prices displayed are inclusive of VAT where applicable
• Delivery fees are displayed clearly before checkout
• You will receive an order confirmation via the app and/or email
Restaurants are responsible for the quality, preparation, and description of the food listed. Cully Express is not responsible for the food itself.
5. Payments
All payments are processed securely through our third-party payment provider. By placing an order, you authorise us to charge your selected payment method for the order total, including any applicable delivery fees.
We do not store full card details on our servers. All payment data is handled in accordance with PCI-DSS standards.
In the event of a failed payment, your order may not be processed.
6. Cancellations & Refunds
Cancellations: Orders may be cancelled before the restaurant begins preparing them. Once preparation has started, cancellation may not be possible.
Refunds: If your order is incorrect, items are missing, or the food is of unacceptable quality, please contact our support team within 24 hours. Refunds are issued at our discretion following investigation.
We reserve the right to cancel any order at any time and will provide a full refund in such cases.
7. Restaurant Partners
By registering as a restaurant partner, you agree to:
• Provide accurate menu information and pricing
• Maintain food hygiene standards as required by UK law
• Fulfil orders accepted through the platform in a timely manner
• Adhere to our Restaurant Partner Agreement
Commission rates and payout terms are agreed separately in your Restaurant Partner Agreement. Cully Express reserves the right to remove restaurants from the platform that breach our standards or these Terms.
8. Driver Partners
Delivery drivers operate as independent self-employed contractors, not employees of Cully Express. As a driver, you:
• Are responsible for your own tax, National Insurance, and legal compliance
• Must maintain valid insurance for your vehicle
• Are responsible for the safe and timely delivery of orders
• Must comply with all applicable UK road laws and regulations
Your engagement as a driver is governed by the Cully Express Driver Agreement, which forms part of these Terms.
9. Acceptable Use
You agree not to:
• Use our services for any unlawful purpose
• Provide false or misleading information
• Attempt to interfere with or disrupt our platform
• Use automated tools to access our services without permission
• Harass, abuse, or threaten other users, drivers, or restaurant staff
• Use our platform to engage in fraudulent activity
Violation of these rules may result in immediate suspension or termination of your account.
10. Intellectual Property
All content on the Cully Express platform — including the logo, app design, text, and graphics — is the intellectual property of A&S Signatures Ltd (trading as Cully Express) or its licensors.
You may not copy, reproduce, distribute, or create derivative works from any of our content without our prior written consent.
Restaurant menu content and images remain the intellectual property of the respective restaurants, licensed to us for display on the platform.
11. Limitation of Liability
To the fullest extent permitted by law, Cully Express shall not be liable for:
• The quality, safety, or legality of food ordered through the platform
• Loss of data, revenue, or profits
• Indirect or consequential losses
Our total liability to you for any claim shall not exceed the value of the relevant order.
Nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud, or any other matter that cannot be excluded under applicable law.
12. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via email or in-app notification. Your continued use of the platform after changes are posted constitutes acceptance of the revised Terms.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
